EN VIRTUD DE LAS DECLARACIONES OTORGADAS, LAS PARTES DE COMUN ACUERDO, DECIDEN SOMETERSE AL RIGOR DE LAS SLGUIENTES:

CLAUSULAS

PRIMERA.- DEFINICIONESE INTERPRETACION.-
PARA LA INTERPRETACION DE ESTE SUBCONTRATO: (I) LAS PALABRAS ESCRITAS CON MAYUSCULA INICIAL, ASI COMO LAS FRASES COMPUESTAS DE PALABRAS ESCRITAS CON MAYUSCULAS INICIAL, SON TERMINOS DEFINIDOS POR ESTE SUBCONTRATO, EN CASO DE NO ETAR DEFINIDOS EN ESTE, EL SIGNIFICADO SER EL QUE EXPRESA Y ESPECIFICAMENTE SE LES ATRIBUYA EN OTRA PARTE DEL SUBCONTRATO O DE LOS ANEXOS QUE LE ACOMPANEN, ( Ⅱ) SALVO QUE EL CO NTEXTO EXPRESAMENTE SENALE LO CONTRARIO, LAS REFERENCIAS A CLAUSULAS, SECCIONES Y PARRAFOS, SUBPARRAFOS Y ANEXOS SON REFERENCIAS A LAS CLAUSULAS, SECCIONES Y PARRAFOS, SUBPARRAFOS Y ANEXOS SON REFERENCIAS A LAS CLAUSULAS,SECCIONES Y PARRAFOS, SUBPARRAFOS Y ANEXOS DEL PRESENTE SUBCONTRATO,(Ⅲ)LAS FRASES “ESTE SUBCONTRATO”Y”PRESENTE SUBCONTRATO “ incluyen las disposiciones contenidas en el cuerpo de este SUBCONTRATO y en todos y cada uno de sus anexos, en el mismo orden, la palabra de refernecia “SUBCONTRATO”,con mayuscula inicial, se debera entender exclusivamente a este SUBCONTRATO y ningun otro,(Ⅳ) los anexos del presente SUBCONTRATO forman parte integrante, incluyente e inseparable del mismo, para todos los efectos a que haya lugar y se tiene como reproducidos en el mismo como si a la letra se insertasen,(Ⅴ)los terminus definidos en forma singular, tendran el mismo significado correlative en plural cuando se utilicen en forma plural y viceversa,(Ⅵ)las palabras referents a personas se entenderan como referencias a personas tanto juridicas colectivas, como fisicas de cualquier naturaleza,(Ⅶ)las referencias en este SUBCONTRATO a las disposiciones del presente SUBCONTRATO o de cualquier otro document, se entenderan tal y como estos sean modificados y snalados y ( Ⅷ ) cuando existan obligaciones a cargo de cualquiera de las partes, estas deberan darles cumplimiento en todos los casos de manera expedita e inmediata.

SUMINISTRO.-consiste en el SUMINISTRO DE ROCA DEL BANCO DENOMINADO “PREDIO RUSTICO NARANJOS” UBICADO EN LA CONGREGACION DE NARANJOS, MUNICIPIO DE PUENTE NACIONAL, VERACRUZ, MEXICO; QUE INCLUYE: LA AUTORIZACION PARA LA EXTRACCION DE LA ROCA Y SUMINISTRO DE LA ROCA EN EL LUGAR DE LA OBRA QUE “ROMPEOLAS” LE INDIQUE POR ESCRITO A “EL

SUBCONTRATA Y ACCESO AL LUGAR PARA MANIOBRAS DE CARGA A PRBCtO UNITARIO Y TIEMPO DETERMINADO.
SEGUNDA.- DE LOS DOMICILIOS
Las partes manifiestan como domicilios para ofr y recibir todo tipo de notiftcaciones, avisos y documentos los-siguientes:

Para el caso de que alguna de las partes llegare a cambiarlo, debera notificarto con 15 (quince) dlas de aniicipacion a la otra parte, en caso contrario todas las notificaciones reaiizadas en el ultimo domicilio senaiado, aun las de caracter personal, surtiran todos sus efectos legales.
TERCERA.- OBJETO DEL SUBCONTRATO.-
“ROMPEOLAS” contrata en este acto a “EL SUBCONTRATISTA” para Uevar a cabo el SUMINISTRO DEUN MILLON DE TONELADAS DE PIEDRA DE NUCLEO Y SECUNDARIOS, MEDiDAS EN BASCULA, INCLUYENDO EXTRACCiON DE ROCA, SELECCION DE ROCA POR PESOS, LIMPIEZA DE ROCA, CARGA A CAMIONES Y PUESTA EN OBRA EN EL LUGAR QUE INDIQUE “ROMPEOLAS“ de acuerdo a los alcances establecidos en el Anexo 2 de este SUBCONTRATO, que firmado por las partes que en el mismo intervienen, se adicbrsa como parte integrante e inseparable del mismo.
“EL SUBCONTRATISTA”debera cumplir con los requerimientos de SUMINISTRO senaiados en el Anexo 2 y que corre agregado como parte integrante -del SUBCONTRATO en el cual sedescriben entre otras, las especificaciones tecnicas que como mmimo debe cumplir.
“EL SUBCONTRATISTA” en este acto, acepta y se obliga a llevar a ca bo todas y cada una de las actividades directas o indirectas a traves de sus propios medios y/o
proveedores y/o subcontratistas y/o de quien considere pertinente, hasta ia total terminacion y entrega a “ROMPEOLAS”del SUMINiSTRO, de conformidad con todas y cad a una de las especificaciones dei SUMINISTRO contenidas en el Anexo 2 apegado siempre a las normas de calidad vigentes para elfo, ast como a los lineamientos existentes y aplicables, de tal manera que "EL SUBCONTRATISTA^adquiere la totaiidad de las obligaciones establcidas en el Anexo 2.
CUARTA.- PARAMETRO CALIDAD DE LA ROCA,
